R -v -TM – Inner London Crown Court.. TM had been charged with Possession with Intent to Supply Class A drugs namely cocaine and heroin and Being concerned in supply of cocaine. Adam Law solicitors were instructed as TM wished to change his plea and change his previous solicitors. An application to vacate plea was heard on the basis that the TM was wrongly advised by his previous solicitors and counsel. This was refused but the Judge stated that in light of the exploitation alleged, it is open to TM to submit a basis of plea. A Basis of Plea was submitted on the basis TM was exploited and coerced. The matter was listed for a Newton Hearing as the CPS did not accept the Basis. At the Newton hearing, the learned Judge heard arguments on the admissibility of the Modern Slavery expert report. The hearing was adjourned where TM gave evidence in support of his basis of plea. The learned Judge made a finding of fact in relation to his exploitation in TM’s favour.
