How long do I have to make a claim for back injury?
It is vital that you make a claim for a back injury as soon as possible after you were injured.
For many reasons any delay in seeking professional legal and medical advice may affect the likelihood of success and the level of compensation. Claims have to be made within three years from when you suffered your spinal injury, or the date of your knowledge of your injury. However even the 3 year cut off needn’t be the end of the road as sometimes exceptions can be made:
- If you suffered your spinal injury before your eighteenth birthday, you can make a claim until your 21st birthday. (Claims for spinal injuries for children under 18 must be handled by an adult and/or guardian.)
- If you need to make a claim for someone who doesn’t have the mental capacity to claim for themselves, the three year time limit doesn’t apply. However if the person injured regains mental capacity, they will then have three years from this date to make a claim.
