R -v -KS – Sheffield Crown Court. Operation Treat

R -v -KS – Sheffield Crown Court. Operation Treat. Represented SW in a multi hander involving 16 defendants over four separate trials, Conspiracies of an organised crime group involved the sale and transfer of firearms and ammunition. Specifically, the criminal enterprise involved the acquisition of blank firing handguns and blank firing ammunition and the conversion of them into viable firearms and live rounds of ammunition. This was done for the purpose of selling the converted firearms and converted ammunition to the criminal underworld for profit. This criminal enterprise was primarily based in Sheffield and the South Yorkshire area.

The Defendant denied the criminality, did not know of the existence of any of the two conspiracies and did not participate knowingly in any conspiracy. At the end of the Prosecution case, submissions were made by the defence of no case to answer. The case against KS was thrown out and NOT GUILTY VERDICTS entered. The case attracted extensive media coverage.

R -v -AL & Others – Snaresbrook Crown Court. Operation Serious

R -v -AL & Others – Snaresbrook Crown Court. Operation Serious. Adam Law Solicitors represented AL concerning conspiracy to possess an imitation firearm with intent to cause fear of violence and conspiracy to possess a firearm without holding a current firearm certificate as well as the supply of Class A drugs. The evidence relied upon was obtained by police involving EncroChat following a UK National Crime Agency operation known as Operation Venetic. That operation used a French/Dutch developed implant to collect data from what had been previously considered to a secure EncroChat messaging system. In order for one user of EncroChat to communicate successfully with another user they must know the unique user identification, or “ handle” of that person. As part of his defence, the defendant denied attribution to the encrypted device and also denied being a user of the device. AT TRIAL AL WAS ACQUITTED OF ALL CHARGES.

R -v -LM Sheffield Crown Court.

R -v -LM Sheffield Crown Court.. Represented LM in relation to Possession of a Firearm and ammunition where LM was linked, by DNA matching his, which was recovered from internal parts of a firearm found in London. The Scorpion Style firearm had been used in shootings in London on a number of occasions over a significant period. Adam Law Solicitors put the Prosecution to proof to identify which part of the firearm the defendant’s DNA was found and whether such an items was a constituent part of the firearm. The defence case was that the DNA which was a mixed DNA must have been transferred by secondary transfer and could not have been as a direct result of handling the firearm. THE PROSECUTION DROPPED THE CHARGES.

R v KH. Sheffield Crown Court. Represented KH who had been charged with possession of a weapon namely a stun gun designed or adapted for the discharge of an electrical current. Successfully persuaded the court that the stun gun did not conform to the definition of a prohibited weapon. A not guilty verdict was entered.

R -v -SG. Sheffield Crown Court. Adam Law Solicitors represented SG for Possession of ammunition, namely 119, 9mm Luger cartridges, 45, 38 Super Auto Calibre cartridges and 30, 9mm Short calibre cartridges without holding a Firearm certificate as well as Being Concerned in the supply of Class A drugs. SG put forward a basis of plea which was accepted by the Crown. SG received a Suspended sentence.

We successfully persuaded the court that the Linher cattle prod did not conform to the definition of a prohibited weapon. A not guilty verdict was entered.
